By using our website or services, you agree to our Terms and Conditions and Privacy Policy. You further agree that you are at least 18 years of age and are not otherwise prevented from entering into a binding legal agreement.
Asist Healthcare, LLC is a for-profit medical tourism travel agency headquartered in Istanbul, Turkey. The terms “us”, “we”, “our”, and “Asist Healthcare” refer to Asist Healthcare, LLC. The terms “site” & “website” refer to www.assisthealthcareturkey.com.
Asist Healthcare, LLC is not a medical service provider and does not provide any advice or opinion of a medical nature (including with respect to any likely results, risks, or side effects). Instead, the purpose of Asist Healthcare is to create an avenue for potential clients to view and obtain information about specific medical facilities in Turkey, make airline reservations to travel to and from Turkey, make hotel arrangements & transportation assistance in Turkey, and assist in connecting clients to doctors that clients have selected by scheduling appointments and facilitating transport to various medical facilities in Turkey.
Asist Healthcare, LLC aims to provide information about Medical Tourism to its clients based on internet research, personal experience, and other sources. Our employees and website provide clients and potential clients the opportunity to compare and research medical procedures, facilities, advice, treatment, diagnosis, and cost to make decisions about the care they may choose to receive in Turkey. Asist Healthcare and its employees are not medical professionals and do not attempt to provide professional medical advice about any medical procedures and treatments. We hold no responsibility or liability of any kind for medical advice and procedures conducted by medical facilities that appear on our website. All medical services rendered are the responsibility of the medical service facility that provides the services, and are governed solely by the terms and conditions of the medical facilities you may enter.
Although we attempt to provide accurate information, your use of any information about medical, dental, cosmetic, non-invasive or any other procedures provided by Asist Healthcare or its affiliates verbally, electronically, or through our website is solely at your own risk. Asist Healthcare makes no representations regarding the completeness or correctness of the information presented, and shall not have any liability or responsibility for any incorrect, incomplete or out of date information that may be provided. All site visitors assume the inherent risks involved with any medical procedures.
Prices provided on our website are considered to be estimates based on up-to-date research gathered from various sources. When viewing our pricing guide, you acknowledge that these prices are subject to significant differences based on a variety of factors. Every medical case is unique and may require additional services to be determined by the medical facility administrators and doctors involved.
Asist Healthcare will not be held liable for any additional medical costs associated with additional services rendered under any circumstances.
Asist Healthcare, LLC is not a referral service. We do not receive any financial compensation from any facilities to endorse their services over others. Statements made on our website, verbally, electronically or otherwise, regarding medical facilities are not facts and should not be viewed as factual information. The information we provide about specific facilities and procedures performed at these facilities is not a substitute for information or advice that may be given by a medical professional. All clients are advised to consult their doctors before pursuing any medical treatment in Turkey.
The Patient is obliged to inform Asist Healthcare of his/her medical background correctly and clearly by filling the medical form that is available on the website with his/her health information.
Asist Healthcare, LLC stands as a bridge between you and the surgeons in Turkey. We do not attempt to provide professional medical advice. All information we provide does not substitute for medical advice provided by a medical professional. Medical professionals may make changes at any moment in order to protect the patient from harm. We are not responsible for any changes or alterations in medical treatment made by medical professionals.
By accepting this Agreement, the Patient agrees, declares and undertakes not to attack or criticise Asist Healthcare or any of its employees, associates or partners publicly (review websites, social media networks, blogs, public forums etc.) in regards to Service Provider’s treatments and actions. As Asist Healthcare cannot be held responsible for the services, medical treatments and procedures provided by the Service Provider, the Patient agrees, declares and undertakes not to bring bad name to Asist Healthcare or any of its employees or take action that negatively affects Asist Healthcare, its reputation, services or management at any time during or subsequent to contract period. In case of breach of this clause, the Patient agrees, declares and undertakes to remove and take down the content immediately upon Asist Healthcare’s assessment. If the content remains, in part or in whole, the Patient agrees, declares and undertakes to pay 10.000,00 GBP to Asist Healthcare as a penalty in addition to all damages.
Cancellations & Delays
Asist Healthcare provides air travel booking services to and from Turkey. Travel plans may require modifications that can alter the cost of travel and hotel accommodations. Asist Healthcare will not be held responsible for cost increases associated with air travel. Any and all fees associated with airline booking, rebooking, cancellations, extensions, and delays will be at the expense of the client. Travel services are provided by 3rd party airlines. Clients are subject to the terms and conditions of airline companies during travel duration periods.
Asist Healthcare provides hotel accommodation booking services in Turkey. Asist Healthcare will not be held responsible or held liable for any changes or price increases resulting from changes to prior agreed-upon travel dates and hotel booking dates. Should travel and hotel dates require changes, Asist Healthcare will attempt to make necessary accommodations on behalf of its clients. All fees and costs associated with booking and rebooking changes, extensions, cancellations, and delays are the responsibility of the clients. Clients may also be responsible for additional booking, rebooking, and cancellation fees from Asist Healthcare.
Travelling to Turkey from your destination often requires airline connections in foreign or domestic cities and countries. Asist Healthcare will not be held responsible or liable for any losses, damages, delays, and cancellations incurred in these locations.
Asist Healthcare facilitates hotel accommodations for its clients while in Turkey. The company does not own or operate any of the hotel facilities it mentions on its website. Asist Healthcare recommends these hotels and their facilities to its clients based on limited cooperation between the separate entities. Asist Healthcare, LLC and its employees are not responsible or liable for any incidents involving its clients while residing at any of the hotel facilities mentioned on its website. Clients enter these facilities at their own risk.
Payment & Refund Policy
Deposit payment
Scheduling a surgical procedure requires the coordination of many different resources. This takes time to handle properly so that the patient will enjoy a quality experience. You acknowledge and agree that upon execution of this Invoice of Surgical Fees (the “Agreement”), Asist Healthcare, LLC. will incur certain costs and expenses in order to schedule and prepare for your procedure(s). As such, you are required to pay to Asist Healthcare a one-time Non-refundable deposit in the amount of $250.00/€250.00/£250.00 (the “Deposit”) concurrently with the execution of this Agreement. You agree and acknowledge that the Deposit shall in no event be refundable, no matter the circumstances. Specifically, failure to obtain medical clearance for any reason shall not entitle you to a refund.
You agree and acknowledge that your payment of the Deposit is valid for one (1) year. Thereafter, you will be charged an additional amount to proceed with this, or any other, procedure(s) with Asist Healthcare. You also understand that should your procedure(s) not occur within one (1) year from the execution date of this Agreement, the prices quoted herein may be subject to change.
Payment and Terms
You agree and understand that the above-quoted amount (the “Amount Due”) only includes the following: pre-and post-operative visits; medical clearance, prescriptions, daily nurse assistance, hotel stay, transfer costs within the airport-hotel-hospital-airport.
Pre-operative tests to determine your suitability for your chosen surgery. Any tests considered necessary during pre-assessment or diagnosis for some treatments, or as a result of a pre-existing condition, or your exposure or vulnerability to any condition will be at additional cost.
Accommodation at the hotel includes your stay and breakfast. The patient is liable for any other costs such as meals (not included as part of our negotiation on your behalf), use of telephone, laundry, etc. at the hotel, or stay at accommodation not booked through us.
You also agree and acknowledge the total Amount Due shall be paid on to the date of your surgical procedure(s). Your failure to remit the total Amount Due by such date will result in the cancellation of your procedure(s). You also agree and acknowledge that payment of the Amount Due, and any rescheduling or cancellation fees, are your responsibility. If someone other than you make any payment(s) towards the surgical procedure(s), then that payer must also sign this Agreement. By signing this Agreement, the payer is agreeing to be held financially liable for any and all payments made, subject to the cancellation policies in Section 3, and any other applicable provisions of this Agreement.
You agree and acknowledge that with any medical procedure results are not guaranteed. To be clear, your obligation to pay the Total Amount Due, as well as any other obligations hereunder, is operative regardless of the outcome of any procedure(s). Your payment is for the services provided hereunder, not the results. In the event that you are not satisfied with the results of your surgical procedure(s), your treatment, or you wish to discuss any payment terms, then you should contact directly to Asist Healthcare. Moreover, you agree to mediate any payment dispute prior to seeking a chargeback from any third party.
If you schedule a revision surgery within one (1) year from the date of your procedure(s), you will be required to pay for: operating room costs, supplies, anesthesia, surgeon’s fees, and other ancillary costs related to that revision surgery. If you schedule a revision surgery more than one (1) year from the date of your procedure(s), then you will be required to pay in full for any revisions, and subject to any change in price.
The Patient cannot take actions incompatible with this article, the Patient accepts, declares and undertakes that the service provider is liable for medical services and additional services which are not under the liability of Asist Healthcare. The Patient cannot take any negative action against Asist Healthcare because of his/her dissatisfaction with medical services provided, otherwise, the Patient will be under obligation to pay, as a penalty, the amount of remuneration paid.
The Patient cannot make adjustments on his/her behalf or on behalf of another person by bypassing Asist Healthcare and directly contacting surgeons and companies from which he/she receives medical service. The Patient cannot disclose text messages, calls, conversations and images between him/her and Asist Healthcare on any platform and anywhere without written permission. Otherwise, the Patient accepts, declares and undertakes that he/she is obliged to pay 10.000,00 GBP as a penalty clause in cash and at once in addition to all damages.
Cancellation of surgery
In the event that you cancel your surgical procedure(s) (for any reason whatsoever), you agree and understand that the following applies:
(a) 30 days’ notice
If you cancel your procedure(s), for any reason whatsoever, and such cancellation occurs thirty (30) or more days before the scheduled procedure(s) (or at any time if no procedure has been scheduled), you will not be entitled to any refund of the deposit payment however, you may reschedule your procedure(s) without the reschedule fee (the “Rescheduling Fee”)
(b) 0-14 days’ notice
If you cancel your procedure(s), for any reason whatsoever, and cancellation occurs less than fifteen (15) days before the scheduled procedure(s), then you agree and acknowledge that you will not be entitled to any refund of the deposit.
You may choose to reschedule your procedure(s) (a “Rescheduled Procedure”), in which case you will be assessed an additional $250.00/€250.00/£250.00 rescheduling fee (the “Rescheduling Fee”) in addition to the Amount Due hereunder. You agree and understand that should you cancel any Rescheduled Procedure; you will not be entitled to any refund of the deposit.
Other Terms
The Patient has obligation to follow and control his/her belongings during the service period, and Asist Healthcare is not liable for lost/stolen/damaged belongings. Asist Healthcare is not liable for belongings lost and events experienced by third parties such as hotel, transfers.
Asist Healthcare reserves the right to make any adjustments or to cancel its program, accommodation facilities and means of transportation due to force major or operational reasons. In such a case, the reservation owner’s approval is not necessary and he/she does not have the right to cancel or compensation.
I understand that photographs and/or videos may be taken of me or parts of my body before, during, and after surgery. These images may be shared with staff, other physicians or health professionals, and members of the public for educational and marketing purposes.
Photographs and/or videos were taken of me or parts of my body as well as details regarding medical services that I have received may be used by Asist Healthcare on social media platforms in order to inform the public or other physicians about plastic surgery.
All additional service fees other than the type of accommodation specified within the scope of the Agreement shall be paid by the Patient in cash during the check-out from the hotel.
It is compulsory to be present at the meeting point two hours before for airway transport.
Refunds and Claims
We are taking extreme measures in order to avoid disputes, claims and chargebacks. We have adopted a zero-tolerance policy in order to help the community in these uncertain times. If you would like to receive a refund for charges or change your mind about having a procedure done, please e-mail our accounting department at accounting@primeassisthealth.com. This department has allowed us to process refunds and claims within 21 days.
Confidentiality
Asist Healthcare, LLC will take necessary precautions to protect the privacy of its clients. This includes using encryption software when sending private medical information electronically in compliance with the Health Insurance Portability & Accountability Act (HIPAA). In some instances, the electronic transfer of information via the internet may be out of our control. We will not be responsible for information that has been hacked or stolen electronically. You are responsible for the content you send using our website and the resulting consequences.
Age Requirement
All visitors to our website must be 18 years of age or older. Users may be required to show proof of age before using the Asist Healthcare website or before engaging in communication with any Asist Healthcare employees.
Limitations of Liability; Indemnification
Other than as expressly provided in these Terms and Conditions, Asist Healthcare does not make any promises or guarantees about the services rendered by us, and will not be held liable under any circumstances, whether directly or indirectly, for any damages resulting from the use of our services. All damages, fees, fines, lost wages, delays, and penalties that arise from any direct or indirect use of this website is solely the responsibility of the individual. By using our website or services, you understand and agree that you assume all risks, whether direct or indirect, that may arise from the use of our website or any of our services or any services provided by our affiliates.
Asist Healthcare and its affiliates, including its employees, management, partners and agents, will not be held liable, directly or indirectly, for any medical procedure (including, without limitation, the results of any medical procedure or the cancellation of or adjustment in any medical procedure) conducted by a facility mentioned on its website or by any affiliate of Asist Healthcare.
All individuals enter into an agreement with any medical facility at their own risk and fall under the terms and conditions of any medical facility they so choose to enter. Users agree to resolve all disputes, repayments, and reimbursements with the medical facilities from which the procedures have taken place. Asist Healthcare will not be responsible under any circumstances, to the fullest extent permitted under applicable laws, to repay or reimburse you or any users of its services or website.
By using this website and our services, each client agrees to indemnify, defend and hold harmless Asist Healthcare, LLC and its affiliates and their respective employees, management, partners and agents, to the fullest extent permitted under law, from and against any and all claims, liability, losses, damages, costs and fees, including legal fees, incurred as a result of, or in connection with, any breach or alleged breach by the client or its affiliates under these Terms and Conditions.
Applicable Law and Jurisdiction
These terms and conditions shall be governed by the laws of the Republic of Turkey, and you consent to the non-exclusive jurisdiction of the courts of Istanbul.
Any change in meaning or contradiction between the provisions of this Agreement does not invalidate any other provision. The Parties are responsible for stamp duty for the copy of this Agreement which they possess.
Evidential Agreement
The Patient accepts, declares and undertakes that Asist Healthcare’s records and books will be evidence for the disputes arising from this Agreement, that he/she will not object to these records and books and will not present any other evidence.
Miscellaneous
These Terms and Conditions may be modified, altered or amended from time to time by Asist Healthcare, LLC. Any changes to these Terms and Conditions will be considered agreed to by the client upon continued use of the website or any services provided by Asist Healthcare.
In the event any paragraph and/or portion of these Terms and Conditions is found to be invalid or unenforceable, the remaining portions of these Terms and Conditions shall remain in full force and effect.
Disclaimer
Asist Healthcare is a medical tourism consulting & logistics travel agency specializing in creating and preparing customized travel packages for medical tourists travelling to Turkey. We provide information based on research, personal experience, and other sources to help assist medical tourists who intend to travel to Turkey for medical, dental, or cosmetic procedures.
We are not medical professionals and do not attempt to provide professional medical advice. We simply create an avenue for our clients to receive professional medical advice and care from trained medical professionals employed at JCI accredited hospitals in Turkey.
All medical care and supervision responsibilities fall under the specific medical facility performing each specific task. By using this site, you agree that Asist Healthcare will not be held liable in any way, directly or indirectly, for any claims, damages, lost wages, refunds, or reimbursements of any kind. All clients are advised of the inherent risks involved with any medical procedure and are fully consenting to any and all activities associated with the services provided by Asist Healthcare.
We outsource third-party vendors to provide medical care, airfare, and hotel accommodations at the request of our clients. We recommend reviewing the terms & conditions of the third party vendors before engaging in any activities or accepting any services.
